1. Eligibility:
The contest is open to all existing and new GigSky users globally, except where prohibited by applicable law. This contest is void where prohibited. Participants must be 18 years of age or older and legally eligible to enter. No purchase is required to participate. Employees of GigSky and their immediate family members are not eligible to participate.
2. Contest Period:
The contest begins on July 19th and ends on August 31st.
3. How to Enter:
There are two ways to enter:
Each person is limited to ten (10) entries, regardless of the method of entry, and regardless of the username, email address, address, phone number or other information used to enter. Any person found to have violated this provision will be disqualified.
4. Prizes:
One (1) Grand Prize of $1,500 USD cash.
5. Winner Selection:
The winner will be randomly selected from all eligible entries received during the contest period. The winner will be notified within ten (10) business days after the contest ends.
6. Prize Claim:
The winner must promptly respond to the notification to claim their prize. GigSky shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within ten (10) days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, the prize may be forfeited and an alternate winner selected.
7. General Conditions:
By participating, entrants agree to these official terms and the decisions of GigSky, which are final and binding. GigSky reserves the right, in its sole discretion to cancel, terminate, modify or suspend the contest should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the contest. In such case, GigSky may (in its sole discretion) select winner(s) from all eligible entries received prior to and/or after (if appropriate) any action taken by GigSky. GigSky reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the contest or website or violates these terms. GigSky has the right, in its sole discretion, to maintain the integrity of the contest, including to void entries for any violation of these terms. By entering the contest, you agree to receive email newsletters periodically from GigSky. You can opt-out of receiving this communication at any time by clicking the unsubscribe link in the newsletter. Any applicable taxes shall be the sole responsibility of the winner.
8. Publicity:
By accepting the prize, the winner agrees to allow GigSky to use their name, likeness, and/or biographical information for promotional purposes without additional compensation.
9. Privacy:
Any personal information collected during the contest will be used in accordance with the GigSky Privacy Policy.
10. Limitation of Liability:
GigSky is not responsible for any damages, losses, or injuries resulting from participation in the contest or the acceptance or use of the prize. By entering, participants agree to release and hold harmless GigSky and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the contest; and (v) electronic or human error which may occur in the administration of the contest or the processing of entries.
11. Governing Law:
THIS CONTEST IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE STATE OF CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this contest, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the State of California having jurisdiction in Santa Clara County. Further, in any such dispute, under no circumstances will either party be permitted to obtain awards for, and each party hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than for actual out-of-pocket expenses (i.e. costs associated with this contest), and each party further waives all rights to have damages multiplied or increased.
12. Social Media:
This contest is in no way sponsored, endorsed, or administered by any social media platforms on which the contest may have been promoted or publicized, including but not limited to Facebook, Instagram and Twitter. Any personal information provided in connection with the contest is being provided to GigSky and not to Facebook, Instagram or Twitter. Any questions or comments regarding the contest must be directed to GigSky and not to any social media platforms on which the contest may have been advertised or administered.
